If you do not agree to these Terms, you should not use the website, submit personal information, request services, or place an order.

These Terms apply to website visitors, customers, account holders, consignors, service applicants, local-pickup customers, and other users of our website and related services, as applicable.

2. Eligibility

You must be legally able to enter into a binding agreement in your jurisdiction to use this website or make a purchase.

Customers who are under the age of majority in their jurisdiction may use the website or place an order only with the involvement and permission of a parent or legal guardian.

By placing an order, creating an account, or submitting information, you represent that the information provided is accurate, complete, current, and authorized for use.

4. Product Information & Listings

Moonlight Collectibles makes reasonable efforts to provide accurate product descriptions, images, prices, availability, quantities, specifications, conditions, and included-item information.

Product images may be representative, supplied by third parties, or used for visual reference. The product received may differ from an image because of artwork, packaging, manufacturer, production, regional, assorted-product, or normal product variations.

Product titles may be shortened because of platform character limits. The listing description, included-items section, product details, and quantity field control what is included in the purchase.

A photograph showing multiple items does not mean that every item shown is included unless the written listing information specifically states that multiple items are included.

5. Product Availability & Inventory

Product availability may change because of sales through multiple channels, inventory adjustments, damage, theft, supplier changes, distributor allocations, technical delays, listing errors, or other operational circumstances.

Adding an item to a cart does not reserve the item. Inventory is generally reserved only after an order and payment have been successfully processed, subject to verification and availability.

If Moonlight Collectibles cannot fulfill an item or quantity, the unavailable item or quantity may be canceled and refunded to the original payment method in accordance with the applicable policy.

6. Collectibles, Condition & Packaging

Many items sold by Moonlight Collectibles are limited-edition, sealed, graded, raw, opened, used, randomized, assorted, unique-condition, or market-sensitive collectibles.

Raw cards, opened products, used items, lots, bundles, holders, snaps, slabs, and similar collectibles may contain visible or hidden condition imperfections.

Factory-sealed products may contain normal manufacturing, distribution, storage, or transportation imperfections, including minor dents, scratches, scuffs, corner wear, wrap irregularities, loose shrink wrap, label variations, seal variations, or other cosmetic packaging flaws.

Unless a listing expressly guarantees collector-grade or mint packaging, minor exterior packaging imperfections do not automatically mean the internal product is defective.

7. Authenticity, Grading & Certification

Moonlight Collectibles does not knowingly sell counterfeit, altered, fraudulently labeled, stolen, or resealed merchandise.

Graded cards may include items certified by PSA, CGC, Beckett Grading Services, SGC, TAG, or other recognized grading providers.

Grades, certification records, population reports, labels, and authentication decisions are determined by the applicable third-party grading or authentication company.

Raw-card inspections and pre-grade evaluations are opinions and do not guarantee authenticity determinations, acceptance, numerical grades, minimum grades, crossover results, regrade results, or future value.

8. Sealed, Randomized & Assorted Products

Sealed, blind, mystery, surprise, assorted, randomized, TCG, CCG, sports-card, entertainment-card, collectible-pack, and bundle products do not guarantee a particular card, item, player, character, team, rarity, parallel, insert, autograph, memorabilia or relic, numbered card, chase item, hit, grade, value, artwork, variant, or outcome unless the listing expressly states otherwise.

Moonlight Collectibles does not control manufacturer collation, pack odds, print runs, product configurations, checklists, pull rates, hit rates, or sealed-product outcomes.

Products described as assorted, random artwork, random design, blind, or mystery will be fulfilled based on available inventory unless the listing guarantees a specific selection.

9. Moonlight Curated Repacks & Bundles

Moonlight Collectibles may assemble and sell curated repacks, mystery products, bundles, care kits, accessory packages, trading-card products, sports-card products, and other collectible assortments.

Merchandise included in Moonlight-curated products is lawfully acquired through manufacturers, authorized distributors, suppliers, marketplaces, collections, trades, purchases, and other legitimate inventory sources.

Moonlight-curated repacks and bundles are assembled or repackaged by Moonlight Collectibles and are not represented as factory-sealed or manufacturer-packaged products unless the listing expressly states otherwise.

Any advertised floor, ceiling, average value, chase item, odds, quantity, or guaranteed content applies only when expressly stated in the individual listing.

Product values may fluctuate. Future market value or resale value is not guaranteed.

10. Fan-Made Art, Custom Products & Thank-You Items

Moonlight Collectibles may sell or include fan-made art, custom products, inspired merchandise, novelty items, promotional items, and independently created products.

When applicable, these products are identified as fan-made, custom, unofficial, inspired, novelty, promotional, or not officially licensed.

Unless a listing expressly states otherwise, fan-made and custom products are not manufactured, sponsored, approved, endorsed, or licensed by the original brand, intellectual-property owner, athlete, team, league, character owner, manufacturer, grading company, or other rights holder.

Moonlight Collectibles may include fan-made artwork, custom artwork, stickers, prints, promotional items, or similar merchandise as a complimentary customer thank-you.

Complimentary thank-you items are provided at Moonlight Collectibles’ discretion, are not guaranteed, have no cash value, are not included in the advertised value of the purchased merchandise, and may vary by order and availability.

11. Market Value Disclaimer

Trading cards, collectibles, memorabilia, sealed products, graded items, and similar merchandise may increase or decrease in market value.

Moonlight Collectibles does not guarantee future value, investment performance, market demand, liquidity, resale price, grading outcomes, pull rates, or collectible appreciation.

Product prices may reflect market conditions, availability, acquisition cost, replacement cost, condition, demand, or other business factors at the time of listing.

12. Orders & Payment

All orders are subject to acceptance, successful payment, payment verification, fraud review, inventory availability, quantity limits, shipping restrictions, and compliance with applicable store policies.

An automated order confirmation acknowledges receipt of the order but does not prevent Moonlight Collectibles from reviewing, adjusting, partially fulfilling, or canceling an order when permitted under these Terms or an applicable policy.

Moonlight Collectibles may refuse service, decline a transaction, cancel an order, limit quantities, request identity or payment verification, correct errors, or take other reasonable action to protect customers, the business, payment systems, inventory, and website security.

All prices displayed on our website are stated in U.S. Dollars (USD) unless expressly stated otherwise.

Customers are responsible for providing accurate billing, payment, contact, shipping, and pickup information.

13. Pricing, Quantity & Listing Errors

Moonlight Collectibles may correct typographical, technical, pricing, quantity, description, image, inventory, or listing errors when discovered.

If an order is affected by an obvious error, Moonlight Collectibles may cancel the affected item, quantity, or order and refund the amount paid for the canceled merchandise.

A displayed price, quantity, description, promotion, image, or configuration resulting from an obvious error or technical malfunction does not obligate Moonlight Collectibles to fulfill the transaction incorrectly.

14. Taxes and Additional Charges

Applicable sales tax is calculated and collected at checkout when required.

International customers are responsible for any customs duties, import taxes, brokerage charges, carrier fees, or government assessments applicable to their shipment unless expressly stated otherwise.

Shipping upgrades, separate-shipment requests, expedited pickup, special handling, insurance, or other optional services may require additional payment when disclosed and approved.

15. Preorders

Preorder purchases are governed by our Preorder Policy.

Payment is collected when a preorder is placed. Preorder demand may create replenishment requests, allocation requests, or purchasing commitments that cannot be reversed with the manufacturer, supplier, or distributor.

Individual preorder items generally cannot be removed from an existing order. A customer requesting cancellation must request cancellation of the entire preorder order.

If Moonlight Collectibles approves the cancellation, a 15% cancellation fee based on the total value of the entire order will be deducted from the refund.

If Moonlight Collectibles receives less inventory than the quantity ordered, the available quantity may be fulfilled and the unavailable quantity refunded.

If no inventory is received, the affected item or order may be canceled and refunded.

Allocation confirmations are generally received shortly before release, and advance individual consultation regarding allocation reductions is not provided.

16. Shipping

Processing times, tracking, insurance, address accuracy, carrier handling, international shipping, claims, delivery delays, restrictions, and other shipment terms are governed by our Shipping Policy.

Customers must review and confirm their shipping address before placing the order.

Moonlight Collectibles is not responsible for delays caused by carriers, customs, weather, incorrect addresses, recipient unavailability, government actions, or other circumstances outside our reasonable control, subject to applicable law and the Shipping Policy.

17. Returns, Refunds & Exchanges

All purchases are final. No returns, refunds, or exchanges are accepted except as expressly provided in our published policies or as required by applicable law.

Damaged shipments, incorrect items, missing items, incomplete orders, merchant cancellations, approved exceptions, and claim requirements are governed by our Return & Refund Policy.

Preorder cancellation requests are governed by the separate Preorder Policy.

18. Local Pickup

Local pickup orders are governed by our Local Pickup Policy.

Customers must wait until the order is marked Ready for Pickup and a pickup appointment has been confirmed before arriving.

Local pickup orders must be collected within five calendar days after being marked Ready for Pickup unless Moonlight Collectibles approves an extension in writing before the deadline.

Orders not collected within the required window and without an approved extension may be considered abandoned and handled according to the Local Pickup Policy.

19. Collector, Grading & Consignment Services

Collector services, grading assistance, collection reviews, consignment, and related services may be subject to separate service terms, submission forms, estimates, fees, agreements, eligibility requirements, or written approvals.

Submitting a request does not obligate Moonlight Collectibles to accept an item, collection, consignment, grading submission, or service engagement.

Estimates, collection reviews, condition opinions, pre-grade evaluations, and recommendations are not guarantees of sale price, grade, authentication, market value, acceptance, or outcome.

20. Order Documentation & Fulfillment Records

For quality control, fraud prevention, shipment verification, order accuracy, claims support, and security, Moonlight Collectibles may document portions of the fulfillment process.

Documentation may include photographs, videos, timestamps, package weights, internal notes, item selection, quantity verification, packaging, sealing, shipping-label application, local pickup, and transfer to a carrier.

These records may be used for customer service, carrier claims, insurance claims, missing-item claims, damaged-item claims, delivery investigations, payment disputes, chargebacks, fraud investigations, legal proceedings, or law-enforcement requests when applicable.

21. Customer Accounts

Customers are responsible for maintaining the confidentiality of their account credentials and for activity conducted through their account.

Customers must notify Moonlight Collectibles promptly if they believe their account, password, or payment information has been compromised.

Moonlight Collectibles may restrict, suspend, or close an account when reasonably necessary to prevent fraud, address security risks, enforce these Terms, or protect customers and the business.

22. Reviews, Feedback & Submitted Content

Customers may voluntarily submit reviews, photographs, comments, testimonials, suggestions, service requests, or other content.

Submitted content must be accurate, lawful, relevant, and must not infringe the rights of another person or contain confidential, threatening, fraudulent, defamatory, malicious, or unlawful material.

By voluntarily submitting content for publication, you authorize Moonlight Collectibles to display, reproduce, format, and use that content for store, customer-service, promotional, and business purposes, subject to our Privacy Policy and applicable law.

Moonlight Collectibles may moderate, decline, or remove submitted content when appropriate.

23. Intellectual Property & Brand References

Product names, trademarks, logos, brands, characters, athletes, teams, leagues, manufacturers, grading companies, and other intellectual property referenced on this website belong to their respective owners.

Third-party intellectual property is used for identification, description, compatibility, commentary, resale, or other lawful purposes. Moonlight Collectibles is not affiliated with, endorsed by, sponsored by, or officially connected to a third-party rights holder unless expressly stated.

Moonlight Collectibles’ original website content, branding, graphics, photographs, videos, written materials, layouts, logos, and other original content may not be copied, reproduced, republished, distributed, or commercially used without permission.

24. User Conduct

Customers and website users agree not to:

• Commit or attempt fraud
• Use unauthorized payment information
• Submit false, misleading, or impersonated information
• Interfere with website, account, checkout, or security systems
• Upload malicious code or attempt unauthorized access

Moonlight Collectibles may restrict access, decline transactions, cancel orders, preserve relevant records, or refuse future service when reasonably necessary to protect customers, staff, the business, inventory, payment systems, or website security.

Our website and operations may rely on Shopify, payment processors, financial institutions, shipping carriers, grading companies, marketplaces, analytics providers, marketing platforms, fraud-prevention services, communication services, and other third parties.

Third-party services may be subject to their own terms, privacy policies, processing times, eligibility requirements, and operational procedures.

Moonlight Collectibles does not control third-party systems and is not responsible for interruptions, errors, outages, delays, decisions, or policy changes caused by third parties outside our reasonable control, subject to applicable law.

26. Website Availability

We do not guarantee that the website, account features, inventory systems, checkout, payment services, links, or other online functions will always be uninterrupted, error-free, current, or available.

Moonlight Collectibles may update, suspend, restrict, remove, or modify website functions, content, products, services, and availability when reasonably necessary.

27. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website, information, services, and products are provided on an “as available” and “as described” basis, subject to the express terms stated in the applicable listing and store policies.

Moonlight Collectibles does not guarantee uninterrupted website access, future product availability, future market value, grading outcomes, resale results, manufacturer production, distributor allocations, carrier performance, or third-party service performance.

Nothing in these Terms excludes any warranty, right, or remedy that cannot lawfully be excluded.

28. Limitation of Liability

To the fullest extent permitted by applicable law, Moonlight Collectibles will not be liable for indirect, incidental, special, consequential, punitive, exemplary, or business-related damages arising from website use, inability to use the website, product availability, market changes, grading outcomes, carrier delays, manufacturer delays, distributor allocations, third-party services, or circumstances outside our reasonable control.

To the fullest extent permitted by law, Moonlight Collectibles’ total liability relating to a particular purchase will not exceed the amount paid to Moonlight Collectibles for the affected product or service.

Nothing in these Terms limits liability, rights, or remedies that cannot lawfully be limited or excluded.

29. Force Majeure

Moonlight Collectibles will not be responsible for delay or failure to perform caused by circumstances beyond our reasonable control.

These circumstances may include manufacturer delays, distributor allocations, supply shortages, carrier disruptions, customs delays, severe weather, natural disasters, fire, flooding, labor disputes, government action, public emergencies, internet outages, cyber incidents, utility failures, payment-processor issues, or other unforeseen events.

30. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses, claims, liabilities, costs, or expenses arising from your unlawful misuse of the website, fraudulent activity, violation of these Terms, infringement of another party’s rights, or submission of false or unauthorized information.

31. Privacy

Personal information collected through this website is handled in accordance with our Privacy Policy.

32. Governing Law

These Terms of Service and transactions with Moonlight Collectibles are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where another jurisdiction’s mandatory consumer-protection laws apply.

The remaining provisions will continue in effect.

A failure or delay by Moonlight Collectibles in enforcing any provision of these Terms does not waive the right to enforce that provision or any other provision later.

These Terms, the policies referenced within them, applicable product listings, checkout disclosures, service agreements, and written transaction-specific terms constitute the agreement between the customer and Moonlight Collectibles concerning the applicable purchase or service.
